| Gravity Interactive Inc, hereafter iRO, and OnGameNet, hereafter oRO, cooperatively offer active and oRO users opportunity to transfer their accounts from oRO to iRO based on their sole discretion, to play its multi-player online computer game "Ragnarok Online" on a pay-for-use basis and As-Is basis.
[LIMITATION OF LIABILITY]
This is an invitation offer to oRO users, not an obligation, to transfer accounts from oRO to iRO based on users' sole discretion. User agrees that oRO will not be held responsible or liable for anything that occurs or results from transferring account to or subscribing to iRO service. After transferring accounts completed, active Oceanic users who have chosen to transfer oRO accounts to iRO accounts will be permanently blocked from oRO and their accounts can not be reinstated in oRO. Moreover, all the oRO data pertaining to those who have chosen to transfer will be permanently deleted and will not be kept for any purpose. The actual transfer will start on March, 14th 2007. After actual transferring process completed, preceding terms and conditions between the users and oRO will not be effective any longer and no longer to be enforceable. All the liabilities and responsibilities of oRO as an online game service provider will be transferred to iRO. The start date and close date of this offering may change if needed to offer better support and service.
AND IN NO EVENT SHALL oRO, OR ANY OF ITS SHAREHOLDERS, PARTNERS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR SUPPLIERS, BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION ANY DAMAGES FOR LOST PROFITS, ARISING (WHETHER OR IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE) OUT OF OR IN CONNECTION WITH THE SERVICE, THE SOFTWARE, YOUR ACCOUNT OR THIS AGREEMENT, WHETHER OR NOT oRO MAY HAVE BEEN ADVISED THAT ANY SUCH DAMAGES MIGHT OR COULD OCCUR.
[AGE LIMITATION]
This offer is only available to individuals of 13 years of age or older. If you are less than 13 years of age and wish to transfer oRO accounts to iRO, your parent(s) or guardian(s) must complete the transfer process, open an Account in their name(s) in iRO and accept full responsibility for all obligations under iRO and oRO agreement.
[ACCOUNTS]
oRO users will have to decide, based on their sole desertion, whether to transfer their account from oRO to iRO or turn down this offer.
Oceanic RO Users with active account status who have chosen to transfer their accounts from oRO to iRO will be PERMANENTLY BLOCKED FROM oRO AND THEIR ACCOUNTS CAN NOT BE REINSTATED IN oRO ONCE THE TRASFERRING ACCOUNTS HAVE FINISHED.
In addition, as stated in Limitation of Liability section, this is an invitation offer to oRO users, not an obligation, to transfer accounts from oRO to iRO based on users' sole discretion. You agree that oRO will not be held responsible or liable for anything that occurs or results from transferring account to or subscribing to iRO service. Active Oceanic users who have chosen to transfer oRO accounts to iRO accounts will be permanently blocked and the accounts can not be reinstated in oRO. [CUSTOMER SUPPORT]
After transferring accounts process completed, active oRO users who have chosen to transfer oRO accounts to iRO accounts must contact iRO Customer Support team, not oRO Customer Support, regarding all inquiries including but not limited to; account ID, password, in-game items, and any other issues related to its multi-player online computer game "Ragnarok Online".
[Description of transferring Rules and Conditions]
(1)Servers
The following rules are valid for the Chaos server on oRO. Accounts and characters from the Sakray server will not be transferred.
Accounts will be given the option to transfer to one of the 3 iRO Servers (Chaos, Loki or Iris)
(2)Accounts and characters
Paid and former paid account can be transferred. Trial accounts will not be transferred. Accounts suspended on oRO will not be transferred. This offer is only valid for accounts which have made a payment prior to the closure of oRO.
For every account, all characters can be transferred.
oRO accounts can not be merged with existing iRO accounts.
oRO account names will be changed to add [ _au ] at the end of all current oRO account names.
(3)Level
There is no limitation regarding Level.
(4)Character names
Character names may not be transferred. Characters names will be changed to show an additional [ _au ] at the end of all oRO transferred character names.
Character name maybe changed after the transfer is completed at no additional charge. This offered is only valid for up to 2 weeks after the release of the account to the player.
(5)Money/Zeny
Level 1-99: 300k for each Level for example 29.7m maximum for Level 99 or 15m maximum for a Level 50. This is cap limit zeny.
- This will only apply to characters that hold in excess of this limit.
(1) For example, a level 50 character with less then 15,000,000 zeny on the character will not have there zeny value changed.
(2) For example, a level 50 character with more then 15,000,000 zeny on the character will have there characters zeny value changed to follow the guideline of 300,000z for each character level.
(6)Items
Only items which are available on iRO can be used. Special event items specific to oRO will be removed including event headgears, event tokens and other special event items.
All items can be transferred, which can be carried by a character. The content of pushcarts and storage will be transferred.
Forged weapons can be transferred. They will have the name "Made in Australia Ħħ.
Special named items such as Christmas Gift Box's, Event Rings and named Headgears may be Nameless once transferred.
MvP Cards including the following Mini Boss cards will not be transferred. Ghostring, Angeling, Dark Illusion, Deviling, Maya Purple, Giant Whisper Card will not transferred. Other Mini Boss cards will transfer.
- Cards will be removed only, if the card was slotted into an item then that item will remain through the transfer.
(7)Pets/Homunculus
Pets & Homunculus can not be transferred
(8)Guilds
Guild can not be transferred. Members of a guild can arrange a new guild on iRO.
(9)Memo points
Memo points will not be transferred.
(10) Married Characters/Adopted Characters
Characters transferred will not retain married status and any adopted characters will not be tied to the former parents. Character may re-marry and re-adopt once they have transferred. Baby characters will retain there baby status but not be linked to any parents and can not be re-adopted.
(11) Character Rankings
Blacksmith & Alchemist ranking points will not transfer. Ranking points will have to be regained on the new server once the characters are transferred.
[PROCESS TIMEFRAME]
User will have the time to decide whether to transfer oRO accounts to iRO until March 21st 2007. The accounts transfers will take place on April 3 rd, 2007, during the iRO regularly scheduled maintenance period.
The actual transfer will start on March 14 th, 2007. iRO will make transfers available for users through the web site until March 21st 2007.
This schedule may change at any point and any changes will be reflected on the iRO website or oRO website to notice about the change in scheduled dates.
After transferring accounts are completed, Oceanic users who have chosen to transfer oRO accounts to iRO accounts will be permanently blocked from oRO and their accounts can not be reinstated in oRO. Moreover, all the oRO data pertaining to those who have chosen to transfer will be permanently deleted in oRO's database and will not be kept for any other purpose.

[INDEMNIFICATION]
At iRO's request, you agree to defend, indemnify and hold harmless iRO, its shareholders, partners, affiliates, directors, officers, employees, agents or suppliers, its licensees, distributors, Content Providers, and other Members of the Service, from all damages, liabilities, claims and expenses, including attorneys' fees and costs, arising from any breach of this Agreement by you.
[DISCLAIMER]
iRO and oRO PROVIDE THE SERVICE, THE SOFTWARE, THE ACCOUNT, THE RAGNAROK GAME AND ALL OTHER SERVICES ON AN "AS IS" BASIS, AND HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES OR CONDITIONS OF ANY KIND, WRITTEN OR ORAL, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF TITLE, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Without limiting the foregoing, we do not ensure continuous, error-free, secure or virus-free operation of the Service, the Software, your Account or Ragnarok Online.
